TEK Utah Terms of Service
These terms govern your use of the TEK Utah website, online accounts, and public digital content. Managed IT, cybersecurity, compliance, and other paid services are governed by the agreement, statement of work, or order form signed for those services.
1. Acceptance and eligibility
By accessing this website or creating an online account, you agree to these Terms. If you use the website on behalf of an organization, you represent that you are authorized to act for that organization. If you do not agree, do not use the website or its account features.
2. Website accounts
You agree to provide accurate information and to protect your login credentials. You are responsible for activity performed through your account and should notify TEK Utah promptly if you suspect unauthorized use. We may suspend or close an account when reasonably necessary to protect users, TEK Utah, or the website.
3. Communications
We may send service-related messages concerning an account, request, appointment, security notice, or active service. Marketing communications are sent in accordance with applicable law and stated communication preferences. You may unsubscribe from promotional email using the instructions in the message; service-related communications may continue when necessary.
4. Acceptable use
You may use this website only for lawful purposes. You may not:
- Attempt to gain unauthorized access to accounts, systems, networks, or data.
- Interfere with the operation or security of the website or services.
- Transmit malicious code, conduct automated abuse, or use the website to harm another person or organization.
- Misrepresent your identity, authority, or affiliation.
- Copy, scrape, republish, or commercially exploit website content except as permitted by law or with written authorization.
5. Intellectual property
The website and its original text, graphics, branding, software, and other content are owned by TEK Utah or used with permission. These Terms do not transfer any ownership rights. Limited personal or internal-business use is permitted only as necessary to evaluate or receive TEK Utah services.
6. Third-party services and specialists
The website and TEK Utah services may rely on third-party platforms, tools, vendors, subcontractors, or specialized professionals. Their products and websites may be governed by separate terms and privacy notices. TEK Utah may coordinate specialized expertise as part of an agreed service while remaining your primary point of contact unless the applicable service agreement says otherwise.
7. Compliance and cybersecurity services
Compliance and cybersecurity services help organizations assess risk, organize evidence, improve controls, and prepare for regulatory, contractual, insurance, or audit requirements. They are not legal advice and do not replace advice from qualified legal counsel, auditors, regulators, or certification bodies.
TEK Utah does not guarantee that an organization will be certified, pass an audit, avoid an incident, or satisfy every legal or regulatory requirement. The customer remains responsible for determining which requirements apply, providing complete and accurate information, approving policies and remediation, maintaining required business processes, and making final risk decisions. Scope, deliverables, responsibilities, exclusions, and fees are defined in the applicable signed agreement or statement of work.
8. Website information and warranties
Public website content is provided for general informational purposes and may not reflect every customer environment or current legal requirement. To the extent permitted by law, the website is provided “as is” and “as available.” TEK Utah does not warrant uninterrupted access or that all public content is complete or error-free. Warranties and remedies for paid services, if any, are stated in the applicable signed agreement.
9. Limitation of liability
To the extent permitted by law, TEK Utah will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of, or inability to use, this public website. Any limitation applicable to paid services is governed by the signed service agreement. Nothing in these Terms excludes liability that cannot lawfully be excluded.
10. Privacy
Our Privacy Policy explains how TEK Utah collects, uses, discloses, and protects personal information associated with the website and services.
11. Governing law and changes
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. We may update these Terms as our website or services change. The revised date above identifies the current version, and material changes will be communicated when required by law or contract.
